General Terms and Conditions (GTC) of mybiobalance.de

1. Scope

These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the website mybiobalance.de between DCW | David Waizmann (hereinafter "Provider") and its customers (hereinafter "Customer").

2. Contracting parties, conclusion of contract

(1) The purchase contract is concluded with DCW | David Waizmann.
(2) The product presentations on our website do not constitute a legally binding offer, but rather an invitation to place an order.
(3) By clicking the order button, the customer submits a binding offer to purchase the goods contained in the shopping cart. The contract is only concluded upon our express acceptance in the form of an order confirmation or shipping confirmation.

3. Prices and payment terms

(1) All prices are final prices and include statutory VAT.
(2) Payment can be made either in advance, via PayPal, credit card or other payment methods offered.
(3) The provider reserves the right to exclude individual payment methods.

4. Delivery and shipping

(1) Delivery shall be made to the delivery address specified by the customer.
(2) The delivery time is stated on the product page or during the ordering process.
(3) If an ordered product is not available, we will inform the customer immediately. Any payments already made will be refunded.

5. Right of withdrawal

(1) Customers have the right to withdraw from the contract within 14 days without giving any reason.
(2) The cancellation period begins upon receipt of the goods.
(3) To exercise the right of withdrawal, the customer must inform the provider by means of a clear declaration (e.g. by e-mail or letter).
(4) In the event of a cancellation, the customer must return the goods immediately and no later than within 14 days. The customer shall bear the return shipping costs, unless otherwise agreed.

6. Retention of title

The goods remain the property of the seller until full payment has been made.

7. Warranty and Liability

(1) The statutory warranty rights apply.
(2) The provider shall only be liable for intent and gross negligence, unless it concerns damage to life, body or health or essential contractual obligations.

8. Data protection

Personal data is processed in accordance with our privacy policy.

9. Final provisions

(1) The law of the Federal Republic of Germany shall apply.
(2) Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction shall be the registered office of the provider, to the extent permitted by law.
